RENTAL BOOKING FORM
With your signature on the booking form you accept these Terms and Conditions as a binding contract
between RED Scooter Tuscany and you, the participant. RED Scooter Tuscany cannot accept any tour participant without a duly signed booking form. Please read the Terms and Conditions carefully.
RELEASE AND WAIVER
Every renter of a vehicle operated by RED Scooter Tuscany is required to accept and sign a release and waiver form of rights before tour start. RED Scooter Tuscany cannot accept any tour participant without a duly signed release and waiver form. A copy of the release and waiver form can be downloaded here.
RESERVATION AND DEPOSIT
Any rental requires a booking deposit at the time of booking. This deposit is 50% of the rental price. This deposit secures the number of scooters being booked.. The balance is due on collection of the scooter(s). The booking deposit is non-refundable and in the case of cancellations represents the cancellation fee.
AGENTS AND REPRESENTATIVES
RED Scooter Tuscany agents and representatives represent RED Scooter Tuscany but are not a party to this contract. Nor are they responsible or liable for failure to provide any service as may be described in our literature pertaining to the contract.
MOTORCYCLE PROVISION/SAFETY DEPOSIT
Motorcycles are provided as part of the rental package. The type/model will be as defined in the contract. The pictures of the motorcycles on the web site (www.scootertuscany.com) and any printed material issued by RED Scooter Tuscany are representative of the vehicles on the RED Scooter Tuscany's fleet but are not of specific vehicles. RED Scooter Tuscany strives to ensure that all participants ride the motorcycle they are confirmed on and is very proud of their record of doing so. Unfortunately, at times, certain unexpected and uncontrollable situations arise which may require the substitution of a motorcycle. This includes, but is not limited to, mechanical failure, collision damage and theft. Should RED Scooter Tuscany not be able to replace a confirmed motorcycle with the confirmed type or similar, a pro - rated refund for the difference in models will be refunded to participant. If this situation arises before the start of a rental the participant will be offered a choice of a full refund or a booking for a later date. This constitutes the maximum liability of RED Scooter Tuscany. Riders are responsible for the first 500 euro towards cost of any damage to the scooter while it is in their care.
EQUIPMENT RENTAL
Any equipment supplied by RED Scooter Tuscany to the client that is returned in a damaged condition will be paid for in full by the client (at the cost of new equivalent replacement equipment)
PRICE OF RENTAL INCLUDES
The items included in the tour price are:
● Hire of scooter(s) for the period as defined in the booking
● Use of up to two helmets for the duration of the rental
● Use of up to two pairs of gloves for the duration of the rental
● Use of a disc lock for the duration of the rental
● A map of the local area
● Scooters are equipped with a lockable top box for carrying small items (max 5kg)
● Third party insurance cover
QUOTED CURRENCIES
All rentals are calculated in Euro. Where another currency is quoted (for example booking forms/enquiries) we will use that day's official exchange rate. Prices remain set in euro and therefore figures quoted in other currencies may vary between time of booking and the balance payment date.
PRICE OF RENTAL DOES NOT INCLUDE
All items not mentioned as included and all items of a personal nature.
BAGGAGE
RED Scooter Tuscany assumes no responsibility for loss, damage or delay in delivering baggage but we do have some storage space in our facility should the client require to do so. Baggage turned over to RED Scooter Tuscany for storage is done so at participant’s own risk. Baggage insurance is recommended.
ITINERARIES
All at RED Scooter Tuscany do their best to describe itineraries accurately, there may be occasion for differences between delivered itineraries and those described on the website
CANCELLATION AND REFUNDS
Cancellations received will be charged at the amount equal to the booking deposit.
REBOOKING
Rebooking of cancellations will be organised subject to availability.
RENTAL CANCELLATION BY RED SCOOTER TUSCANY
If RED Scooter Tuscany is forced to cancel a booking a full refund of the amount paid for the rental booking will be provided. RED Scooter Tuscany is not liable for any additional costs or losses incurred by the tour participant due to RED Scooter Tuscany’s cancellation of rental. This includes, but is not limited to, the cost of pre-paid airline tickets, hotel reservations and automobile rentals. Situations may arise which, in our opinion, make it necessary for us to cancel, advance or postpone booked rentals. In that event, we do not assume responsibility or liability for any resulting losses, expenses or inconvenience. RED Scooter Tuscany is not required to make refunds once a rental vehicle is delivered to the client regardless of the reason for participants being unable to complete his or her tour.
REQUIRED EQUIPMENT
All tour participants riding on motorcycles must bring suitable clothing and protective gear.
DAMAGE TO SCOOTERS
The rentor is responsible to look afte rthe vehicle in his possession. In the event of any damage or accident involving a third party the rentor is liable for a 500 euro deductable. This deductable is classed as the security deposit and will be secured against the credit card of the rentor.
PHOTO & GRAPHICAL MATERIAL
Any photogrpahic or video material produced by RED Scooter Tuscany or its representatives on tour are the property of RED Scooter Tuscany. The copyrights remains with RED Scooter Tuscany. RED Scooter Tuscany can use all of this material for advertising and marketing purposes, including images in which individual tour members can be recognized, without any charge from the tour member arising for RED Scooter Tuscany for this use of material.
PASSPORT, VISA, DRIVING AND HEALTH REGULATIONS
The customer is responsible for complying with above regulations and all consequences resulting from non-compliance.
NON-OBSERVANCE OF TRAFFIC LAWS AND GROUP TRAVEL REGULATIONS
If the customer does not comply with traffic laws or the requirements for group travel, the contract may be cancelled by RED Scooter Tuscany and the provided motorcycle secured.
RESPONSIBILITY
RED Scooter Tuscany is responsible for providing the services listed in the tour description according to the local standard and the accurate description of services offered in its literature. RED Scooter Tuscany carefully selects and constantly checks its contractors, such as hotels and restaurants. RED Scooter Tuscany is responsible for conscientious travel preparations. RED Scooter Tuscany is not responsible or liable for any accidents. RED Scooter Tuscany reserves the right without prior notice to withdraw any part or all of a tour, to make such changes as may be necessary, and the extra cost, if applicable, resulting there from, shall be paid by the customer. Furthermore, it is agreed and understood that the owners, operators and agents of this tour including RED Scooter Tuscany are not the guardians of any customer’s safety and they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or the client’s participation in connection with the tour, which might result in injury, death or other damage to the client, his property, or his family, heirs, or assigns. The liability of RED Scooter Tuscany as the tour operator is limited to a total of three times the rental price irrespective of the title/claim. RED Scooter Tuscany is not responsible for any delays, changes in schedule or other conditions.
WEATHER CONDITIONS
RED Scooter Tuscany cannot be made liable for unpleasant or unsuitable weather conditions and no refunds are made for such conditions.
RENTAL RATES AND MOTORCYCLE COSTS
Rates quoted on this website or any printed material are those in effect at time of writing. RED Scooter Tuscany may change the rates at any time prior to 30 days before your confirmed booking.
INSURANCE
RED Scooter Tuscany recommends that you take out adequate travel, health and accident insurance as well as trip cancellation insurance. RED Scooter Tuscany hold 'Tour Operators insurance' which covers public/product liability, professional indemnity and tour cancellation through insolvency of RED Scooter Tuscany. Scooters are covered by third party insurance.
PRINTING ERRORS AND CALCULATION MISTAKES
RED Scooter Tuscany reserves the right to correct printing errors or calculation mistakes at any time.
VERBAL CHANGES of contract are invalid unless confirmed in writing by RED Scooter Tuscany.
